The State Bar Board of Trustees' Regulation and Discipline Committee (RAD) is seeking an active State Bar licensee to serve as the Special Deputy Trial Counsel (SDTC) Administrator under Rule 2201 of the State Bar Rules of Procedure. This is a part-time, contract position.
SDTCs serve in place of the State Bar's Chief Trial Counsel in disciplinary matters where the Office of Chief Trial Counsel (OCTC) has been recused. The Administrator is responsible for receiving all referrals from OCTC, conducting preliminary review of all matters, and determining whether the matter should be referred to an SDTC for further processing, including prosecution. Within the SDTC program, the Administrator alone has the powers and duties of the Chief Trial Counsel. Accordingly, the Administrator supervises the SDTCs and is the final decision-maker on all determinations, including settlement. Additionally, the Administrator prepares and presents reports to the Board of Trustees, reviews and assigns complainant requests for second-look review of closed complaints, ensures timely processing of complaints, coordinates SDTC trainings, reviews and approves all SDTC invoices, assists SDTCs as needed in their cases, and assists in recruitment of new SDTCs.
Applicants should have knowledge and experience in legal ethics, conducting investigations, litigation, State Bar Court rules of procedure and practice, and managing others. Training and materials are provided by the State Bar. State Bar Rules of Procedure, Rule 2201, is attached.
Details:
• Contract position
• Part-time, approximately 40 hours per month but hours may vary
• Remote, within the state of California
• Billing rate is $275 per hour for Administrator functions
• Reimbursement for travel and expenses
• Administrator and SDTCs are precluded from representing Respondents or testifying in State Bar disciplinary matters
