The Consumer Protection Branch (CPB) enforces federal consumer protection laws throughout the United States. CPB brings both criminal prosecutions and civil enforcement actions in matters of national importance related to adulterated and misbranded products, consumer frauds, and data-privacy violations. The Branch also defends against suits in district courts challenging consumer protection agencies’ regulatory actions. Job Description:
The Consumer Protection Branch seeks Department of Justice attorneys to serve on one-year non-reimbursable details to handle enforcement actions related to electronic nicotine delivery system (ENDS) products, including e-cigarettes. Responding to an increase in youth usage of flavored ENDS products, the FDA recently has taken actions to prohibit or restrict the sale of certain ENDS products that fail to meet the standard Congress established to protect the public health. The Branch expects that civil and criminal enforcement efforts will likely be necessary to address continued sales of prohibited products. Detailee attorneys will have the opportunity to work on the full range of anticipated affirmative litigation.
Detailee attorneys will work closely with attorneys from CPB and various U.S. Attorney’s Offices to investigate and pursue appropriate civil and criminal cases. Detailee attorneys also will engage regularly with FDA personnel and Department leadership.
In addition, detailee attorneys may have the ability to handle other affirmative matters across the range of CPB’s work, including matters related to prescription drug diversion, consumer frauds, and data-privacy violations.
Detailees may perform work from their current home district so long as they are able to travel as required for court proceedings.
Qualifications:
Required Qualifications
: Applicants must be a current Department of Justice attorney with a J.D. degree, be an active member of the bar (any U.S. jurisdiction) and have at least three years of post-J.D. experience. Applicants also must have excellent writing, research, and advocacy skills.
Preferred Qualifications
: Experience handling affirmative civil or criminal enforcement actions, as well as prior service as a federal judicial law clerk is preferred.
Salary:
Under a detail assignment, there is no change to the selectee’s base pay or grade level. Temporary promotions are not authorized.
Travel:
Domestic travel may be required.

Suitability and Citizenship
: It is the policy of the Department to achieve a drug-free workplace and persons selected for employment will be required to pass a drug test which screens for illegal drug use prior to final appointment. Employment is also contingent upon the completion and satisfactory adjudication of a background investigation. Congress generally prohibits agencies from employing non-citizens within the United States, except for a few narrow exceptions as set forth in the annual Appropriations Act (see, https://www.usajobs.gov/Help/working-in-government/non-citizens/

Pursuant to DOJ component policies, only U.S. citizens are eligible for employment with the Executive Office for Immigration Review, U.S. Trustee’s Offices, and the Federal Bureau of Investigation. Unless otherwise indicated in a particular job advertisement, qualifying non-U.S. citizens meeting immigration and appropriations law criteria may apply for employment with other DOJ organizations. However, please be advised that the appointment of non-U.S. citizens is extremely rare; such appointments would be possible only if necessary to accomplish the Department's mission and would be subject to strict security requirements. Applicants who hold dual citizenship in the U.S. and another country will be considered on a case-by-case basis. All DOJ employees are subject to a residency requirement. Candidates must have lived in the United States for at least three of the past five years. The three-year period is cumulative, not necessarily consecutive. Veterans
